New Delhi: The Supreme Court of India upheld the abrogation of Article 370 today - December 11, 2023. While pronouncing the verdict, the Supreme Court stated that no special status will be granted to Jammu and Kashmir.
What Is Article 370 of the Indian Constitution?
Article 370 of the Indian constitution gave special status to Jammu and Kashmir. In August 2019, the Parliament passed The Jammu and Kashmir Reorganisation Act, 2019, bifurcating the state into two Union Territories, bringing an end to Article 370.
What is Article 35A?
Article 35A was issued by the President of India in 1954 under Article 370. As per the constitution, this article "demarcated permanent residents with the exclusive right to purchase land, seek State government employment and other benefits in education and health care in Jammu and Kashmir". This article, however, was scrapped in 2019 along with Article 370.
Supreme Court Upholds Removal of Article 370
The verdict was announced by the constitutional bench led by Chief Justice of India DY Chandrachud and Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant.
While pronouncing the verdict, the SC upheld the Centre's decision of removing Article 370 in Jammu and Kashmir. The apex court also ordered the Election Commission of India to conduct elections in Jammu and Kashmir by September 30, 2024, and restore its statehood at the earliest.
